Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Ridacity platform (“Ridacity,” “we,” “us,” or “our”), including our website, mobile applications, and related services (collectively, the “Services”). By creating an account or using our Services, you agree to these Terms in full.

1. Acceptance of Terms

By accessing or using Ridacity, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services. We may update these Terms from time to time; continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use Ridacity. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement. Renters must hold a valid driver’s license in their country or state of residence and meet any additional requirements imposed by hosts or applicable law.

3. Account Registration

You must create an account to access certain features of Ridacity. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Ridacity reserves the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraudulent activity.

4. The Ridacity Platform

Ridacity is a peer-to-peer marketplace that connects vehicle owners (“Hosts”) with individuals who wish to rent vehicles (“Renters”). Ridacity is not a party to the rental agreement between Hosts and Renters and does not own, operate, or insure any vehicles listed on the platform. Ridacity acts solely as an intermediary, facilitating connections and processing payments.

5. Host Obligations

As a Host, you agree to: (a) list only vehicles that you own or are legally authorized to rent; (b) ensure your vehicle is roadworthy, properly maintained, and meets all applicable safety standards; (c) maintain valid registration and insurance coverage that permits third-party rentals; (d) accurately describe your vehicle and disclose any known defects; (e) comply with all applicable local, state, and federal laws regarding vehicle rentals; and (f) complete the Ridacity identity verification (KYC) process as required.

6. Renter Obligations

As a Renter, you agree to: (a) hold a valid driver’s license for the class of vehicle being rented; (b) use the vehicle only for lawful purposes and in accordance with the host’s stated terms; (c) not use the vehicle for commercial purposes (including rideshare or delivery) unless explicitly authorized by the Host and permitted under the applicable insurance policy; (d) return the vehicle in the same condition in which it was received, subject to normal wear and tear; (e) report any accidents, damage, or incidents to Ridacity immediately; and (f) provide accurate identification documents through our KYC process.

7. Payments & Fees

All payments are processed through our third-party payment provider, Stripe. By making a booking, you authorize Ridacity to charge the payment method on file for the full rental amount, including applicable service fees and taxes. Host payouts are processed after the rental period concludes, subject to any holds for disputes or damage claims. Ridacity charges a service fee on each transaction, the current rate of which is displayed during checkout. All fees are non-refundable except as expressly stated in our Cancellation & Refund Policy.

8. Cancellations & Refunds

Refunds for cancelled bookings are governed by the cancellation policy selected by the Host at the time of listing (Flexible, Moderate, or Strict). Ridacity service fees are non-refundable in all cases. Refund eligibility is calculated based on how far in advance of the rental start date the cancellation is made. Ridacity reserves the right to issue full refunds at its discretion in cases of documented vehicle unavailability, misrepresentation, or safety concerns.

9. Insurance & Liability

Hosts are solely responsible for ensuring adequate insurance coverage for their vehicles during rental periods. Ridacity does not provide insurance and is not liable for any loss, damage, injury, or other harm arising from the use of vehicles listed on the platform. Renters assume full responsibility for any damage caused to the vehicle during their rental period beyond normal wear and tear. Ridacity’s total liability to any user for any claim arising from or related to these Terms or the Services shall not exceed the total fees paid by that user to Ridacity in the three months preceding the claim.

10. Prohibited Uses

You may not use Ridacity to: (a) engage in any unlawful activity; (b) harass, threaten, or defraud other users; (c) list stolen or encumbered vehicles; (d) circumvent Ridacity’s payment systems; (e) create fake reviews or manipulate the rating system; (f) scrape or copy platform content without authorization; or (g) interfere with the security or integrity of the platform. Violation of these prohibitions may result in immediate account termination and legal action.

11. Termination

Ridacity may suspend or terminate your account at any time, with or without cause, and with or without notice. You may close your account at any time by contacting support@ridacity.com. Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including payment obligations, indemnification, and liability limitations.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
